My name is Brian Treacy. I am the owner of this LowCountry Elder Law and Estate Panning Website and blog. My office is known as The Law Office of Brian T. Treacy, LLC. and it is located in Bluffton, South Carolina, minutes away from the beautiful beaches and golf courses of Hilton Head Island.  I have been practicing law for over 25 years and have dedicated the past 16 years to Elder Law and Estate Planning. Very simply, my law practice is primarily devoted to addressing the legal and financial problems facing elder clients their families, and the disabled community.  Not all of our clients are senior citizens and Elder Law is not all we practice. Every adult, young and old, ought to have a Will, and I am glad to help clients of every age bracket. We also handle residential real estate closings and bankruptcies.

My hope is that this Website and blog becomes a resource for clients and their families as well as all who participate in the Elder Law and Elder Care "network". It aims to help those who find it difficult navigating the rapidly changing laws that effect the elder community and the disabled. Our readers will include other attorneys, financial planners and health care providers.

I have extensive experience in helping seniors and the disabled  maximize resources, retain their independence for as long as possible, and protect their assets as the aging process progresses. These goals are accomplished through  life care planning as well as particularized estate planning

Part of the practice requires out-of-office visits to the homebound, to hospitals,  Assisted Living Facilities (there are various ALFs in the area and are all quite nice, see the Links page), and nursing homes; another part requires court appearances and attendance at real estate closings and seminars. Many hours are spent listening to client's problems and then offering soulutions by way of common sense legal advice, sometimes entire families are involved. Hours are spent drafting both simple and complex planning documents or preparing detailed applications for government benefits programs.

The best asset preservation plan is a preventative one. That is, one established before crisis strikes. However, we do not run away from the challenges that sudden and unplanned for crisis bring.  I try to help families develop a care plan at the first sign of declining health to help avoid both the stress of crisis management that lack of planning brings. No one can weave through the maze of medicare, medicaid and social security entanglements, while at the same providing the best quality of life and medical care available without firm professional guidance.

The best estate plan is one that assures all assets are distributed as directed in your will, or trust,  to hiers as quickly as possible after death, and at the least cost to the estate. In some cases that can be accomplished by having a $100 Simple Will. In some cases more is required. You will always be advised of how to acheive your goals in the cost effective way..

Finally, we also work in the areas of bankruptcy, probate, estate and trust administration.

I am licensed to practice in South Carolina and New Jersey. In addition to state and local bar associations, I am a member of the National Academy of Elder Law Attorneys and the Elder Committees of both South Carolina and New Jersey. 

I am dedicated to trying to give clients and those within the elder care network  the information they need to make sound decisions. I often speak at seminars, civic and religious clubs/organizations without remuneration, but with great satisfaction knowing afterwards that I have been able to impart helpful bits of knowledge accumulated through years experience. 

I live in one of Bluffton's beautiful golf course communities and is adjacent to scenic lowcountry marshland. My passions are golf, music, coaching my daughter's softball team, and my work. The rest of my time is filled with reading books, surfing the web, blogging and getting to know more about the local community.
